1. Description of Service

WorklyJobs is an online job board platform designed to connect employers with potential candidates across the United States, Canada, the United Kingdom, Australia, and New Zealand. We act strictly as a venue for employers to post job opportunities and for job seekers to post resumes and apply for such opportunities. We are not an employment agency or a recruiting firm, and we do not guarantee employment or the successful filling of any job vacancy.

2. User Accounts

To access certain features of the platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security and confidentiality of your password and account credentials.
  • Accept full responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account or any other breach of security.

3. Employer Obligations & Job Postings

If you are using WorklyJobs to post job openings, you represent and warrant that:

  • Accuracy: All job postings are for genuine, available positions and contain accurate descriptions of the roles and requirements.
  • Legality: Your postings comply with all applicable local, national, and international labor and employment laws, including but not limited to laws regarding anti-discrimination, minimum wage, and equal opportunity.
  • Prohibited Content: You will not post jobs that involve multi-level marketing (MLM), pyramid schemes, illegal activities, or jobs requiring an upfront fee from the candidate.

WorklyJobs reserves the right to remove any job posting or ban any employer account at our sole discretion, without notice or liability, if we determine the content violates these Terms.

4. Job Seeker Obligations

As a Job Seeker, you agree that:

  • The information provided in your resume, profile, and applications is truthful, accurate, and represents your actual experience and qualifications.
  • You will not use the platform for any purpose other than seeking employment opportunities.
  • You acknowledge that WorklyJobs does not conduct background checks on employers and you are solely responsible for verifying the legitimacy of any company you interact with.

5. User-Generated Content

By submitting content (such as job postings, resumes, or company profiles) to WorklyJobs, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, publicly display, and distribute such content for the purpose of operating and providing our services. You retain all ownership rights to your submitted content.

6. Disclaimer of Warranties

WorklyJobs is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the site, the accuracy of the job postings, or the quality of the candidates. We do not endorse any employer or job seeker and are not responsible for the outcome of any hiring process.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall WorklyJobs, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
